21st Annual Motul Petit Le Mans Grand Marshal Contest – Remembering Don Panoz

Dr. Don Panoz will be remembered within the racing community as a visionary champion of our sport, the founder of one of the greatest endurance races of all time —Petit Le Mans, and the savior for Road Atlanta when it was in a desperate time of need. Most importantly, he recognized that without the fans, none of his efforts would work. 

We are quickly approaching the 21st running of the Motul Petit Le Mans, sadly our very first without “Dr. P” as he was affectionately known. He built this event and revived this racetrack for you, the fans, enabling all of us to witness the incredible spectacle of sports car endurance racing that he fell so deeply in love with. This is a legacy we are committed to continuing, so we want to give this opportunity back to you, our fans, in his honor. 

IMSALast year, Dr. Panoz served as the Grand Marshal at the 20th Anniversary Motul Petit Le Mans. This year, to celebrate all that he accomplished and the passion with which he served sports car racing aficionados around the world, we’re inviting fans to submit their stories regarding how they were impacted by Dr. P, Petit Le Mans, any of the Panoz race cars, or the American Le Mans Series. One winner will be selected to honor the legacy of Don Panoz and serve as the Grand Marshal at the 21st Annual Motul Petit Le Mans. We think Dr. P would be proud to be honored this way, as he lived by the mantra “For the Fans.”

By entering this Contest, Entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the judges.

ELIGIBILITY. The Motul Petit Le Mans Grand Marshal Contest (“Contest”) is open only to legal residents of the 50 United States and the District of Columbia, who are nineteen (19) years of age or older at the time of entry (“Entrant”). Void where prohibited, taxed or restricted by law. All federal, state and local laws and regulations apply. Road Atlanta, LLC (“Sponsor”), NASCAR, Inc., and its affiliates and each of their respective employees, shareholders, officers, directors, members, agents and assigns, and each of their respective parent companies, affiliates, subsidiaries, and advertising/promotional agencies, and members of the immediate family or persons living in the same household of such individuals, and teams participating in IMSA sanctioned events, are ineligible to participate. Void where prohibited by law. Subject to all federal, state and local laws.

HOW TO ENTER: Beginning on September 24, 2018 at 12:00:00 a.m. Eastern Time (“ET”) through 11:59:59 p.m. ET on September 28, 2018 (“Contest Period”), an eligible individual may enter the Contest by submitting an essay describing the impact Dr. Don Panoz had on them or how his contributions to Motul Petit Le Mans, Road Atlanta, and the sportscar racing world have impacted their life. To enter, submit a 350 word or less essay (“Essay”) to Road Atlanta at . All Contest submissions must contain only one Essay and be submitted by 11:59 p.m. ET on September 28, 2018 to be eligible (collectively, an “Entry”). Limit one (1) Entry into the Contest per person, household and email address. Sponsor is not responsible for lost, late, illegible, misdirected, incomplete Entries. 

Entries must not be indecent or obscene, be violent in nature, or depict illegal activity of any kind. Entries must comply with all Entry Requirements seen below, as determined by Sponsor in its sole discretion. Entries that Sponsor deems to be inappropriate for any of these reasons will be disqualified.

ENTRY REQUIREMENTS: Each Entry must comply with the following additional requirements (“Entry Requirements”): 

  1. The Entry may not contain any content that is lewd, obscene, sexually explicit, pornographic, disparaging, defamatory, libelous, obscene, or that otherwise contains inappropriate content or objectionable material as determined by Sponsor in its sole and unfettered discretion. 
  1. The Entry must be the Entrant’s original work, created solely by the Entrant, and must not infringe the copyright, trademark, privacy, publicity, or other intellectual rights of any person or entity. 

 

  1. The Entry must not contain any personally identifiable information of any person other than the Entrant. Should the Entrant include personally identifiable information about him/herself in his/her Entry, Entrant acknowledges and agrees that such information may be disclosed publicly and Entrant is solely responsible for any consequences thereof. 
  1. Entrants may not be, nor may Entrant work with parties in conjunction with their Entries, who: 1) are represented under contract (e.g., by a talent agent or manager) that would limit or impair Sponsor’s ability to display the submissions in any media form; or 2) are under any other contractual relationship, including but not limited to guild and/or union memberships, that may prohibit them from participating fully in this Contest, or from allowing Sponsor to use royalty-free, the Submissions worldwide in all media in perpetuity. 

 

  1. The Entry must not contain any commercial content or logos.
  1. The Entry may not have been previously published and may not have won previous awards.

 

  1. The Entry may not contain any material or elements that are not owned by the Entrant and/or which are subject to the rights of third parties. 

By submitting your Entry, you agree that your Entry conforms to these Official Rules and that Sponsor, in its sole discretion, may disqualify your Entry for any reason at any time, including if it determines, in its sole discretion, that your Entry fails to conform to these Official Rules in any way or otherwise contains unacceptable content as determined by Sponsor, in its sole discretion. 
By submitting an Entry, Entrant hereby grants permission to Sponsor for the Entry to be posted on the Road Atlanta website. Entrant agrees that Released Parties (as defined below) are not responsible for any unauthorized use of Entries by third parties. Released Parties do not guarantee the posting of any Entry. Entrants agree that they will not use the Entry for any other purpose, including, without limitation, posting the Entry to any online social networks, without the express consent of Sponsor in each instance. 

CONTEST JUDGING: All qualified Entries submitted to Sponsor will be judged by a Sponsor-specified judging panel based on the following criteria (“Judging Criteria”): 

  1. Creativity (25%)
  2. Relevance (25%)
  3. Originality (25%) 
  4. Historical References (25%)

The qualified Entry with the highest overall score using the Judging Criteria above will be deemed the Contest winner. In the event of a tie, the Entry with the highest score from Judging Criteria #2 will be deemed the winner from among all tying Entrants. In the event that a tie still exists, the winner will be selected based on the highest score from Judging Criteria #4. The prize is subject to verification of eligibility and compliance with these Official Rules. Decisions of judges are final and binding in all matters related to the Contest.

WINNER NOTIFICATION: The Contest winner will be notified by telephone and/or email on or before 5:00 PM ET on Wednesday, October 3, 2018. Judges’ and Sponsor’s decisions are final and binding on all matters relating to this Contest. Contest winners may be required to sign and return to Sponsor any required Affidavit of Eligibility/Release of Liability and Publicity form within two (2) days of notification of winning the Contest. Failure to do so within this time period will result in disqualification, in which case an alternate winner may be selected. If a winner’s notification is returned to Sponsor as undeliverable this will result in disqualification and the naming of an alternate winner, time permitting. Correspondence will not be acknowledged. All Essays become the property of the Sponsor and will not be returned. No substitution or transfer of prize permitted. All federal, state, and local taxes on prizes are the sole responsibility of the winner. All federal, state, and local laws and regulations apply. Acceptance of the prize offered constitutes permission to use Contest winner’s name or likeness in advertising and promotional activities (including public relations press releases and television/radio interviews and website promotions) without additional compensation. 

PRIZE AND APPROXIMATE RETAIL VALUES (“ARV”): One (1) Prize: Two (2) tickets for the 21st Annual Motul Petit Le Mans on October 10, 2018 through October 13, 2018 at Road Atlanta, and selected to be the Grand Marshal for the 21st Annual Motul Petit Le Mans at Road Atlanta and be involved in pre-race ceremonies as determined by Sponsor in its sole discretion. ARV: $250.00. If the Contest winner is disqualified for any reason, cannot participate on the dates specified, or refuses to sign the Affidavit of Eligibility/Liability & Publicity Release Form and all documentation required by Sponsor as set forth in the WINNER NOTIFICATION section of these Official Rules within the required time, then the Sponsor may select an alternate Contest winner using the Judging Criteria, time permitting. Guest must be at least nineteen (19) years old. Guest must also sign a Liability & Publicity Release and all documentation required by Sponsor. No travel or other accommodations will be provided for the Contest winner. Only information specifically listed in the prize list above will be provided. Schedules are subject to change without notice. Tickets cannot be sold or traded on auction websites, are not transferable and at no time may be purchased, sold, bartered or otherwise exchanged for the value except at Sponsor’s sole discretion. The Released Parties will not replace any lost or stolen tickets, or similar items once they are in Contest winner’s possession or in the possession of his/her guest. Some restrictions may apply. 

Contest winner and guest are also responsible at their own expense for all additional federal, state and local taxes, if any, and any other unspecified expenses associated with acceptance or use of the prize including, without limitation, all meals, ground transportation, taxes and gratuities. No difference between the stated ARV and actual ARV will be awarded. Odds of winning depend on the number of eligible entries received. 

RELEASE: By entering and/or participating in the Contest, winners agree to indemnify and hold Sponsor, NASCAR, Inc. and their parent(s), affiliates, subsidiaries, and each of their respective shareholders, directors, officers, employees, members, agents, successors, and assigns (collectively, “Released Parties”) harmless from any and all liability, damages or causes of action (however named or described) with respect to or arising out of the participation in this Contest and the use of prizes awarded. Contest winner gives permission to Sponsor to use winner’s name and/or likeness for purposes of advertising, publicity and promotion without further compensation except where prohibited by law. All Essays submitted to Sponsor become the property of Sponsor and can be used for advertising, publicity and promotion without further permission or compensation except where prohibited by law. Winners assume all liability for any injury or damage caused, or claimed to be caused by participation in this promotion or use or redemption of any prize. 

By entering and/or participating in the Contest, Entrant represents and warrants that his or her submission(s) and all elements thereof: (i) are the original work of the Entrant; (ii) have not previously been published or won an award or prize of any kind; (iii) do not infringe or violate the rights of any third party, including but not limited to, copyrights, trademarks, patents, trade secrets, logos, contract and licensing rights, rights of publicity or privacy, moral rights, or any other intellectual property rights; (iv) are not subject to any third party agreements, and that the Sponsor will not be required to pay or incur any sums to any person or entity as a result of their use, exhibition or exploitation of the submission or elements therein; (v) any required permits from local authorities and other permissions have been obtained; (vi) do not contain any content that is likely to be considered offensive by Sponsor or could adversely affect the name, reputation, or goodwill of the Sponsor. 

RIGHT TO DISQUALIFY AND CANCEL: Sponsor reserves the right, in its sole discretion, to disqualify any individual found, in Sponsor’s sole discretion, to be tampering with the operation of the Contest, or to be acting in violation of the Official Rules (which are final and binding); to be acting in violation of the terms of use of the Road Atlanta website, or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Sponsor reserves the exclusive right to cancel the Contest should a virus, bug, unauthorized human intervention or other cause beyond Sponsor’s control corrupt or impair the administration, security, fairness or proper play of the Contest. Any Essay that contains any obscene or inappropriate content, or content that violates the intellectual property or other rights of third parties, as determined by the Sponsor or independent judge in their sole discretion will be disqualified. Sponsor reserves the right to disqualify any Essay based on its sole discretion. Sponsor reserves the right to amend, modify, or terminate the Contest at its sole discretion. 
ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION. 

Sponsor may prosecute any fraudulent activities to the full extent of the law. The failure of either Sponsor to comply with any provision of these Official Rules due to an act of God, act of domestic terrorism, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of either (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.

Governing Law AND DISPUTE RESOLUTION: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Contest shall be governed by the laws of Georgia, without giving effect to the principles of comity or conflicts of laws thereof. Except where prohibited by law, as a condition of participating in this Contest, Entrant agrees that any and all disputes and causes of action arising out of or connected with this Contest, or prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules including the Optional Rules for Emergency Measures of Protection, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The place of arbitration shall be in the State of Georgia. Except as may be required by law, the arbitration shall be confidential and neither party nor an arbitration may disclose the existence, content, or results of any arbitration hereunder without the prior written consent of both parties. Under no circumstances will Entrant be permitted to obtain awards for and Entrant hereby waives all rights to claim punitive, incidental and/or consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. 

Severability: If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
